1. Agreement
By accessing or playing Glyphrest (the “Game”), including its website and any related online services (together, the “Service”), you agree to these Terms and to the Acceptable Use Policy, and you acknowledge the Privacy Notice. If you do not agree, do not use the Service.
2. Who we are
The Game is created, owned and operated by Jacob Unger (also known as “Hellzthunder”), referred to here as “we”, “us” or “our”.
3. License to play
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to access and play the Game through its official website for your own personal, non-commercial entertainment. The Game is licensed, not sold. All rights not expressly granted to you are reserved by Jacob Unger.
4. What you may not do
Except as expressly allowed in these Terms or with our prior written permission, you may not:
- copy, download for redistribution, mirror, frame, re-host, sell, rent, lease, lend, sublicense or distribute the Game or any part of it;
- modify, translate, decompile, disassemble or reverse engineer the Game, or create derivative works, clones or ports of it, except to the limited extent applicable law expressly allows despite this restriction;
- extract, scrape or reuse the Game’s artwork, icons, models, audio, code, data or other assets for any purpose, including in other products or to train machine-learning or AI models;
- remove or alter any copyright, trademark or other proprietary notice;
- access the Service other than through the Game’s normal interface, interfere with it, or get around any security measure or limit;
- use the Service for anything unlawful, or in violation of the Acceptable Use Policy.
5. Early access
Glyphrest is in early access and under active development. Features, balance, content, art and the world itself may change, be added or be removed at any time, and updates may occasionally reset or alter saved progress. We may suspend or discontinue the Game, in whole or in part, at any time.
6. Accounts and saves
You need an account to play online. To make one you must be 13 or older; if you are under the age of majority where you live, you confirm that a parent or guardian has agreed to these Terms with you. Give only a username and password: we never ask for your real name or email address. One account is for one person.
Keep your password and your recovery code private. Anyone who has them can use your account, and you are responsible for what happens on it. Because we don’t collect email addresses, we can only help you back into an account if you still have its recovery code; if you lose both your password and your recovery code, we may not be able to restore it.
When you play signed in, your heroes and progress are saved to your account on our servers. We work to keep them safe, but early-access games can have bugs, and we don’t promise that progress will never be lost or reset. If you choose Play offline, your heroes are saved only in your own browser on that device: we can’t see or recover them, and clearing your browser data may lose them.
Heroes, items, marks, ranks and anything else in the game are part of the Service, not your property, and have no real-world value. They can’t be sold or exchanged for money or anything outside the game. You can delete your account at any time from the title screen (Account → Delete account).
7. Hero names and online play
Choose usernames and hero names that follow the Acceptable Use Policy. When you play an online hero, other players can see your hero’s name, appearance, level, title and movements, and the emotes and quick-chat phrases you send, and the public hiscores show your hero’s name, class, ranks and experience. These Terms and the Acceptable Use Policy apply to everything online; we may publish additional rules, and we may refuse or change a name, hide a player, remove a hero from the hiscores, reset progress that was gained unfairly, or end a connection to keep the game fair and friendly. As we add online features (such as shared adventures or trading), these Terms apply to them too.
8. Fan content
You may make and share videos, streams, screenshots, art and writing about the Game, including on monetized channels, as described on the Legal page, as long as you credit the Game, don’t imply that we endorse you, and don’t distribute the Game itself or its extracted assets. We may withdraw this permission for content that is unlawful, harmful or misleading.
9. Ideas and feedback
If you send us suggestions, ideas or feedback about the Game, you agree that we may use them freely, without any obligation or payment to you.
10. Ownership
The Game and everything in it, including its code, design, world, characters, writing, art, icons, effects, sounds and the selection and arrangement of all of these, belong to Jacob Unger or are used under license. “Glyphrest” and its crest are trademarks of Jacob Unger.
11. AI-assisted content
The Game was made with the help of AI tools: much of its code and writing was produced with Claude (Anthropic), and many of its illustrations and icons were generated with Gemini (Google), under our direction and then selected, edited and arranged by us. These tools are used under their providers’ terms. Glyphrest is not affiliated with or endorsed by Anthropic or Google.
12. Suspension and termination
We may suspend or terminate your account or your access to the Service at any time, with or without notice, if we believe you have broken these Terms or the Acceptable Use Policy, or to protect the Service or other players. You may stop using the Service, and delete your account, at any time. Sections that by their nature should survive termination (including ownership, restrictions, disclaimers, limitation of liability and indemnity) will survive.
13. No warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT SAVED PROGRESS WILL BE PRESERVED.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JACOB UNGER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, PROFITS, GOODWILL OR USE, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.
Some jurisdictions don’t allow certain disclaimers or limitations, so some of the above may not apply to you.
15. Indemnity
You agree to indemnify and hold harmless Jacob Unger from any claims, damages, losses and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or of anyone else’s rights.
16. Other services
The Service relies on third parties such as our hosting providers (Render, which runs the game’s server, and DreamHost, which hosts its database), Google Fonts (typefaces) and the cdnjs content network (which serves the three.js library). Their own terms and policies apply to their services, and we are not responsible for them.
17. Governing law
These Terms are governed by the laws of the State of [YOUR STATE], United States, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in [YOUR STATE], and you consent to their jurisdiction, except where the law of your country of residence gives you a right to bring a claim locally.
18. Changes to these terms
We may update these Terms from time to time. The “Effective” date above shows when they last changed. Changes take effect when posted; if you keep using the Service afterwards, you accept the updated Terms.
19. General
These Terms, together with the Acceptable Use Policy and Privacy Notice, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the Game.
